Terms of Service

These Terms of Service ("Terms") are an agreement between Zlotrak Ltd ("we", "us"), which runs Marketzlot Stores, and you, the business or person who creates an account to open an online store ("you"). By creating an account or using Marketzlot Stores, you agree to these Terms, our Privacy Policy and our Refund Policy.

1. What Marketzlot Stores is

Marketzlot Stores gives you the tools to run an online store: a storefront, product and stock management, orders, customers, delivery areas, promotions, reports and connections to payment providers. We provide the software. You are the seller: the contract for each sale is between you and your customer, not between your customer and us.

2. Your account

  • You must be at least 18 and able to enter a binding contract, and the details you give us must be true and kept up to date.
  • You are responsible for everything done through your account, including by team members you invite. Keep your password safe and tell us at once if you think your account has been misused.
  • One login can own one store. You may invite staff with the roles the platform offers.

3. Your store and what you sell

You are fully responsible for your store, including:

  • the products and services you list, their descriptions, photos and prices, and that you have the right to sell them;
  • fulfilling orders, delivery, returns, refunds and customer service for your customers;
  • your own store policies (return, delivery, privacy, terms) — we provide templates, but you must check they fit your business and the law;
  • any licences, permits, taxes (including VAT, GST/HST or sales tax) and reporting your business requires;
  • complying with consumer-protection, advertising, data-protection and other laws that apply to you and your customers.

4. What you may not sell or do

You may not use Marketzlot Stores to sell or promote anything illegal where you or your customers are, or anything that is counterfeit, stolen, hazardous without proper licensing, or that infringes someone else's rights. This includes, for example, illegal drugs, weapons and ammunition sold without the required licences, adult content, gambling, pyramid or "get rich quick" schemes, and items prohibited by our payment providers. You also may not: mislead or defraud customers; send spam; try to break into, overload or copy the platform; or use another business's name or branding without permission. We may remove listings, suspend or close stores that break these rules.

5. Payments

  • Online payments are processed by our payment partners — Flutterwave for stores in Nigeria and Stripe for stores in other supported countries. To accept online payments you must connect a payout account (a bank account through Flutterwave, or your own Stripe account) and accept that provider's terms.
  • Customer payments go to your payout account through the provider; Zlotrak Ltd does not hold your sales money. Settlement times, chargebacks and provider fees are set by the provider.
  • Pay on delivery payments are collected by you directly.
  • You are responsible for refunds, disputes and chargebacks on your sales, including any costs a provider charges for them.

6. Plans and platform fees

  • Marketzlot Stores offers a free plan and paid plans. Each plan's price, limits (for example products, team members and storage) and platform fee are shown in your dashboard under Plan & usage.
  • On plans with a platform fee, a percentage of each online sale (which may be capped per sale) is deducted automatically at the time of payment by the payment provider. The fee applies to the order total paid online.
  • Paid plans are paid in advance, for 1, 3, 6 or 12 months at a time. If a paid period ends and is not renewed, your store moves to the free plan.
  • Plan prices follow your business's country. Your store's country sets its currency, and you pay plan charges in that currency at that country's price. The country must be where your business actually operates, and it can't be changed once a plan has been paid for. If a store's country is not accurate, we may move it to the correct country's plan price, ask you to pay the difference, or suspend paid features.
  • We may change prices, limits or fees. We will give you at least 30 days' notice of increases that affect you, and the change applies from your next billing period.

7. Your content and data

You keep ownership of your content (products, photos, text, logos) and your store's data. You give us permission to host, copy, display and process it as needed to run your store and the platform. You must have the rights to everything you upload. Our Privacy Policy explains how we handle personal data; for your customers' personal data, you decide how it is used and we process it on your behalf to run your store.

8. Our platform

Marketzlot Stores, its software, design and brand belong to Zlotrak Ltd. You may use them only to run your store under these Terms. We work hard to keep the platform available and secure, but it is provided "as is": we don't promise it will be uninterrupted or error-free, and we may change, add or remove features.

9. Suspension and closing your account

  • You can stop using Marketzlot Stores and close your account at any time by contacting us.
  • We may suspend or close a store, with notice where reasonable, if you break these Terms, if required by law or a payment provider, if your store puts customers or the platform at risk, or if a paid plan stays unpaid. Where we can, we will tell you why and give you a chance to fix the problem.
  • After closing, we may keep records we are required to keep by law; other store data is deleted within a reasonable time. You can ask us for an export of your data before you leave.

10. Limitation of liability

To the extent the law allows: we are not liable for indirect or consequential losses such as lost profits, lost sales or lost data; we are not responsible for the products you sell, your dealings with your customers, or the services of payment providers, couriers or other third parties; and our total liability to you for any claim is limited to the amount you paid us in platform fees and plan charges in the 3 months before the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Indemnity

You agree to cover us for claims, losses and costs (including reasonable legal fees) arising from your products, your store, your breach of these Terms or the law, or your dealings with your customers.

12. Changes to these Terms

We may update these Terms. For important changes we will tell you by email or in your dashboard at least 14 days before they take effect. If you keep using Marketzlot Stores after that, you accept the new Terms.

13. Governing law and disputes

These Terms are governed by the laws of Nigeria. We will first try to resolve any dispute with you informally; if we can't, it will be decided by the courts of Nigeria, unless the law where you are based gives you the right to bring it elsewhere.
